Report as called for is placed through the learned counsel for the State submitted by the Sub Divisional Controller, Malda. The report be kept with the record.

The report is dated 10.11.2025, wherein it has been stated as follows.
"this is to inform you that in connection with W.P.A. No. 21472 of 2025 (Maruf Khatun vs. The State of West Bengal & Ors.), a licence had already been issued in favour of Smt. Marufa Khatun on 18/02/2025.
Subsequently, the Hon'ble Justice Subhendu Samanta was pleased to pass an order on 24/02/2025.
In view of the above, Our response is that we don't have any reason to stand in the way. If the Hon'ble court directs, we will abide by that and necessary action shall be taken strictly in accordance
with the directions of the Hon'ble Court in MAT 1543 of 2024."

On hearing the learned counsels for the parties and on considering the materials on record, more so the report filed by the authority concerned, wherein it appears that a licence has already been issued in favour of the petitioner herein on 18.12.2025, that is 6 days prior to an interim stay granted by a Coordinate Bench vide order dated 24.02.2025, it is directed that the writ petitioner shall act as per the licence granted but the same shall be subject to the directions/decision of the Hon'ble Division Bench in MAT 1543 of 2024.

The writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
