Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the uncle of the victim deceased. They had been staying separately for about 13 years. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. She relies on the statement of the de facto complainant who is the mother of the alleged victim and other local witnesses. Two other co-accused standing on a similar footing had been arrested and thereafter granted bail. It is indeed quite surprising that the victim, after going to her father's place, would be able to collect some poison to commit suicide. The circumstances concerning the death are quite suspicious.
Considering the incriminating materials available in the case diary including the statements of the mother of the victim and the local witnesses, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner.
The application for anticipatory bail being CRM (A) 3228 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
