Subhasish Ray v. State Of West Bengal
Sr.24 23-09-2021 Subha.
Court no. 34
IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 2834 of 2012 In the matter of : Subhasish Roy ....petitioner. In Re : An application under Section 401 and Section 482 of the Code of Criminal Procedure.
Mr. Arijit Ganguly Mr. Sandip Chakraborty .....for the State.
The revisional application was preferred against the order dated 17-07-2012 passed by the learned Addl. Sessions Judge, Fast Track Court, 4th Court, Barrackpore. The petitioner was aggrieved by the interpreter who was engaged by the court in respect of the victim girl who was deaf and dumb.
Mr. Chakraborty, learned advocate for the State submitted a report wherein it reflects that four of the witnesses have already been examined and the trial of the case is in progress.
The report submitted by the Officer-in-Charge, Khardah PS, Barrackpore Police Commissionerate through the learned advocate for the State be kept with the record. Record of this revisional application also reflects that the petitioner approached this court at a stage when date was fixed for evidence for CSW1. The petitioner in fact is participating in the trial otherwise the evidence could not have progressed.
No prejudice has been effectively canvassed regarding the interpreter who has already been engaged by the court.
It is for the trial court to decide if the interpretation is proper or not. I do not find any justified reason to interfere with the order under challenge.
Accordingly, the present revisional application being CRR 2834 of 2012 is dismissed.
All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
