Mr. Dipanjan Dutt, learned advocate appearing for the petitioner prays for expeditious disposal of the proceedings of Complaint Case No.783 of 2019 which was filed under the provisions of Section 12 of the PWDV Ac with reliefs under the relevant provisions of the said Act. The said case is pending before the learned Judicial Magistrate, 1st Court, Barasat. Learned advocate submits that the prayer relating to interim relief particularly with regard to Section 23(2) and Section 19 of the said Act which are of urgent in nature are still pending before the court even after the case has been filed almost four years ago. The next date as has been pointed out is on 17th October, 2023.

Having considered the urgency now involved in the present application for interim reliefs after four years, I direct the learned Judicial Magistrate, 1st Court, Barasat to dispose of the application for interim relief on 17th October, 2023 and if the same is not possible on the said date concerned positively by 20th

November, 2023. Learned trial court after the issue relating to interim relief is over would consider regarding the progress of the trial of the case as the same is pending for a period of four years. At least once in every two months the date must be fixed so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 3333 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
