09.09.2024 AD-23 Court No.29 TN (Allowed) CRM (A) 3153 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Mogra Police Station Case No. 80 of 2024 dated 03.03.2024 under Sections 419/420/406 of the IPC. And In the matter of: Umesh Kumar Routh @ Umesh Kr. Meshtar @ Umesh Kr. Rawat @ Abhay Singh @ Umesh Kr. Routh .... petitioner Mr. Navanil De, Ms. Monami Mukherjee ....for the petitioner Ms. Amita Gaur, Ms. Ratna Ghosh ....for the State 1.

Considering the materials available in the case diary and having regard to the fact that the dispute is with regard to the non-payment of EMIs to Bajaj Finance Limited following which the said vehicle has been seized by Bajaj Finance Limited and the allegations against the petitioners are omnibus in nature, we are of the view that custodial interrogation of the petitioner is not necessary. 2.

Accordingly, we direct that in the event of arrest, the petitioner, namely, Umesh Kumar Routh @ Umesh Kr. Meshtar @ Umesh Kr. Rawat @ Abhay Singh @ Umesh Kr. Routh shall be released on bail upon furnishing a bond of Rs.10,000/-, with two registered sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) Signed By :

of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS, 2023.

The petitioner shall meet the Investigating Officer once in a week till submission of the final report.

It is further directed that the present accused petitioner shall appear before the learned Chief Judicial Magistrate, Hooghly within two weeks from date.

Accordingly, the application for anticipatory bail is disposed of.
