Petitioner participated in the SLST 2016 (Upper Primary) for being appointed as Assistant Teacher and subsequently appeared before the grievance committee on 13th August, 2021 for consideration of his candidature.

The concerned authority of the School Service Commission passed an order dated 13th August, 2021 rejecting the candidature of the petitioner on the score that petitioner was found untrained candidate on 24th October, 2016 being the cut off date. The said order of the concerned authority of the Commission dated 13th August, 2021 is assailed in this writ petition.

After hearing the learned advocate representing the petitioner, this Court has posed a

query to the learned advocate whether any provision is there which makes the petitioner entitled to be considered for appointment as Assistant Teacher in Upper Primary section in connection with SLST 2016 even though petitioner is an untrained candidate or the petitioner acquires training qualification after the cut off date of 24th October, 2016. However, this Court does not get any satisfactory reply.

In absence of any provisions which could have made the petitioner eligible to be considered for being appointed as an Assistant Teacher in Upper Primary section in connection with SLST 2016 even though petitioner is an untrained candidate or acquired qualification after the cut off date of 24th October, 2016, this Court refuses to interfere with the writ petition.

Accordingly, the writ petition stands dismissed.

However, there shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
