An application for modification has been filed by the petitioner for modifying the direction passed in the order dated 13th November, 2018.

The Court after hearing the submissions of both the parties by order dated 13th November, 2018 directed the Land Manager being the respondent No.2 to consider and dispose of the application filed by the petitioner in accordance with law within a specified time.

It has been submitted by the petitioner that presently the authority to deal with the representation of the petitioner is the Estate Manager, Urban Development Department, the respondent No. 3 herein. The application for modification has been made to direct the authority of the respondent No.3 to deal with the representation of the petitioner in place and instead of the respondent No.2.

The learned advocate appearing for the State respondents submits that presently the Estate Manager, Urban Development Department, respondent no.3 is the appropriate authority to deal with the issue. In view of the submissions made on behalf of both the parties, the direction given upon the respondent No.2, Land Manager, Urban Development Department to consider and dispose of the representation of the petitioner is hereby modified and directed that the respondent No.3, being the Estate Manager, Urban Development Department shall consider and dispose of the application filed by the petitioner in accordance with law within a period of eight weeks from the date of receipt of a copy of this order upon giving an opportunity of hearing to the petitioner and the respondent No.3 shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

Rest of the order dated 13th November, 2018 remains unaltered.

The application being CAN 1 of 2021 stands disposed of.
