1. None appears on behalf of the private respondent.

2. The petitioner and private authority are represented through their learned Counsels.

3. The petitioner submits that despite service made upon the private respondent in compliance of the order dated 12.11.2025, is not appearing today.

4. A copy of the affidavit-in-opposition be kept in record.

5. The petitioner submits that the sole issue involved herein is with regard to the payment of the balance amount of provident fund.

6. Mr. Prasad for the Provident Fund Authority submits that it is exempted trust under Section 17 of the Employees Provident Fund Act, 1952, the accumulation is lying with the trust.

7. In view of the above, since the matter pertains to the arrear dues of the Provident Fund contribution of the petitioner for the period from 01.04.1999 to 28.02.2001. The Assistant Provident Fund Commissioner, R.O. Howrah with the assistance of respondent No.1 shall consider the case of the petitioner within the period of six weeks and shall pass an appropriate order upon considering element of disbursement of arrear dues to the petitioner in accordance with law and the said decision be communicated to the petitioner within a week thereafter.

8. With the above observations and directions, this writ petition WPA 21387 of 2025 is disposed of with the merits of the case.
