1. Although the petitioner is not named in the FIR, considering the statement of the wife and son of the victim recorded under Section 164 of the Code of Criminal Procedure directly implicating the petitioner along with others in physically assaulting the victim which is the immediate cause of his death, we are not inclined to grant anticipatory bail to the petitioner.

2. Accordingly, the application for anticipatory bail is rejected.
