Arabinda Mondal v. State Of West Bengal And ORS.
Court No. 17 WPA 21678 of 2022 Arabinda Mandal Vs.
The State of West Bengal & Ors.
17.02.2023 (AD 7) (S. Banerjee) Mr. Firdous Samim Ms. Gopa Biswas Ms. Mousumi Hazra Ms. Payel Shome ... for the petitioner Mr. Pallav Chatterjee Mr. Tanweer Jamil Mandal ... for the respondent nos. 5 and 6 Mr. Saikat Banerjee Mr. Ratul Biswas Mr. Kaushik Chowdhury ... for the WBBPE A report has been filed by the Chairman of the District Primary School Council, Purba Bardhaman (not Purba Medinipore as was wrongly recorded in the last order dated 06.02.2023).
In paragraph 9 of the said report it has been stated that the council is ready and willing to give appointment to the petitioner subject to the liberty of the Hon'ble Court as the matter is pending adjudication before the Hon'ble Court.
The petitioner's minor daughter was suffering from heard disease and that is why he could not participate in the counseling.
Considering the situation of the petitioner, this court must show a humanitarian gesture and I think that no illegality will be caused if the petitioner is given appointment as such liberty is granted by this court to the DPSC. Such appointment is to be given by four weeks from the date of communication of this order. With the above observation and direction, this writ application is disposed of.
