This is a contempt application being CPAN 161 of 2024, which Mr. Chatterjee seeks to move today before the court. However, Mr. Ray appearing for the alleged contemnor has informed the court that an appeal has been taken out against the order of this court dated 13.12.2023 which is now pending. He seeks an appropriate order to be passed in view of such facts. However, Mr. Shamik Chatterjee has raised strong objection and he seeks that the interim order passed by this court on 31.1.2024 be extended. It is submitted that unless the same is extended, the concerned contemnor would proceed for realization of the alleged overdrawn amount from his client, which according to him is only illegal.
However, since the Hon'ble Division Bench the matter is now in seisin over the appeal, this court is not intended to pass any further order in this case. In view
of the entire circumstances, this court strongly believes that the alleged contemnor would not proceed any further in this matter until and unless the Hon'ble Division Bench finally decides the matter. However, the petitioner is always at liberty to mention the matter before the court if and when it is found necessary. Let this matter be adjourned today and come in the monthly list of April, 2024.
