Learned advocate representing the petitioner relies upon a communication made by his client, which is taken on record, and submits that there are incurable defects in the instant writ petition and hence he prays for withdrawal of the instant writ petition with liberty to file a fresh one on the selfsame cause action upon proper facts and documents.

The West Bengal State Information Commission is represented and leaves the matter to the discretion of the Court.

In view of such submission, the writ petition stands dismissed as 'withdrawn'.

Leave is granted to the petitioner to file writ petition afresh on the self-same cause of action with proper and better particulars.
