1. By way of this writ petition styled as a Public Interest Litigation the petitioner alleges that the 11th respondent is putting up an illegal and massive building in the land comprised in L.R. Plot No. 1954 of Mouza Mobarakpur, L.R. Khatian No. 2511, J.L. No. 201 under P.S. Memari, Purba Burdwan.

2. According to the petitioner, the construction which has been put up is illegal and wholly unauthorized and has to be immediately stopped. The Officer-in-Charge, Memari Police Station, Purba Burdwan has filed a report dated 11.09.2023 stating that as on date there is no semblance of any construction and there is only a small room, however, at the time of Kali Puja and Saraswati Puja, the people of the locality erected a Pandal and after the Puja is over, the Pandal is dismantled and no permanent structure has been put up.

3. In the light of the said report, though at present, there may not be any construction being put up, the 6th respondent viz. the Sub-Divisional Officer, Burdwan

Sadar (South) is directed to conduct a spot inspection of the area and ensure that no illegal or unauthorised construction is put up on the said property.

4. With the above observations, the instant writ petition stands disposed of.
