As none appears on behalf of the State, Ms. Jyotsna Roy Mukherjee, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appearance may be regularized by the concerned authority.

I have considered the contentions advanced in the writ petition and I find that the dispute which has been canvassed, absolutely relates to a civil dispute.

The petitioner has already approached the learned Executive Magistrate under Section 126 and under Section 163 of the BNSS.

Having considered the dispute which has been canvassed in the writ petition, I am of the view that any interference of this court under Article 226 of the Constitution of India is not called for.

However, as the learned Executive Magistrate is in seisin of the matter, the police authorities would keep a strict vigil and ensure that no breach of peace and tranquility takes place at the locale.

With the aforesaid observations, WPA 21934 of 2024 is disposed of.
