The petitioners are claiming to be the Headmaster and the Secretary of the Managing Committee of Kalinagar Junior High School.

The representation of the petitioners praying recognition of the said school as Junior High School is pending before the concerned authority, the petitioners are praying direction upon the said authority for disposal of their said representation.

The West Bengal Board of Secondary Education had forwarded the application of the petitioners for such recognition to the Commissioner of School Education, Government of West Bengal for necessary steps.

The Commissioner of School Education, on receipt of such application directed the District Level Inspection Team to conduct inspection and

on such inspection, existence of such a school was not found.

That being the position, there cannot be any scope for consideration of the prayer of the petitioners for recognition of such a school. Learned Counsel for the petitioners submits that subsequently, a new building has been constructed for the said school.

Be that as it may, a new building would not alter the situation, it may, at best, give rise to fresh prayer for recognition.

W.P.A. 21324 of 2023 is dismissed with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
