The petitioner alleges that notwithstanding an application made to the Director, Directorate of Industries, being the respondent no. 2 as far back as on August 11, 2015, the respondent no. 2 has taken no steps whatsoever in considering or disposing of the application of the petitioner.

It is an unfortunate state of affairs that an application filed by the petitioner is pending with the respondent no. 2 since 2015.

In view of the fair submission made by Mr.

Abhratosh Majumder, learned Additional Advocate General, appearing on behalf of the State, I dispose of this writ petition by directing the respondent no. 2 to consider and dispose of the application of the petitioner dated August 11, 2015 (Annexure P-16, page 256 to the writ petition) within a period of 8 weeks from the date of passing of this order in accordance with law

In considering and disposing of the aforesaid application the respondent no. 2 will give a right of hearing to the petitioner as well as the concerned State representatives.

The respondent no. 2 will also pass a reasoned order and communicate the same to the petitioner forthwith thereafter.

With the aforesaid directions WPA No. 19590 of 2019 stands disposed of.

There shall be, however, no order as to costs. I make it clear that I have not gone into the merits of the case and all issues are left open to be decided by the respondent no. 2 without being influenced by any observation made in this order on the merits of the case. I also make it clear that the aforesaid timeframe is peremptory and no adjournment is to be granted to any of the parties on frivolous grounds.

In the event, the representation of the petitioner dated August 11, 2015 is not disposed of by the respondent no. 2 within the time frame, liberty is granted to the petitioner to take appropriate steps in accordance with law as they may be advised.
