1. Heard the learned lawyers for both parties.
2. We have considered the materials on record. Petitioners are not the principal accused. They are in the custody for about two years. There is no possibility concluding the trial in the near future. Co-accused is on bail.
3. Accordingly, we are inclined to enlarge the petitioner on bail.
4. Accordingly, we direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of Additional Chief Judicial Magistrate, Balurghat, Dakshin Dinajpur subject to condition that petitioner shall appear before the learned Trial Court on every date of hearing until further order and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
5. In the event, petitioners fail to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel their bail prayer in accordance with law without further reference to this Court.
