The petitioner alleges that the concerned investigating officer without carrying out proper investigation submitted a chargesheet before the concerned Jurisdictional Magistrate under Sections 498A/302 IPC.

In this writ petition the petitioner has prayed for a direction upon the 2nd respondent namely Additional Director General of Police, CID to undertake further investigation into Kultali P.S. Case No. 405/2024.

Mr. Deb Roy, learned Additional Government Pleader files a report of the Inspector-in-Charge, Kultali P.S. dated 6th of September, 2024 which is taken on record. It appears from the said report that

after completion of investigation, Kultali P.S. CS No. 590/2024 dated 4th of September, 2024 under Sections 498A/302 IPC has been filed against the accused respondent namely Biplab Mondal.

Mr. Deb Roy submits that this Court should not pass any order directing further investigation to be made. Since the chargesheet has been submitted, it will be open to the petitioner to approach the learned ACJM, Baruipur for appropriate reliefs in this regard.

With the above observations and directions the writ petition is disposed of.

However, there will be no order as to costs.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
