September 3, 2024 AD 24 & 97 Ct. 17 SG WPA 22444 of 2022 Dr. Rakhi Roy Halder vs.

Loreto College and others with WPA 21956 of 2024 Dr. Rakhi Roy Halder vs.

University of Calcutta and others Mr. Arkadipta Sengupta Ms. Aayushi Mukherjee ... for the petitioner.

Mr. Soumya Majumdar Mr. Saptarshi Banerjee Mr. Kuntal Banerjee ... for the respondent Nos.1 & 2 Mr. Nilotpal Chatterjee Mr. Satyaki Banerjee ... for the Calcutta University in WPA 22444 of 2022 Mr. Nilotpal Chatterjee Mr. Sourabh Sengupta ... for the Calcutta University in WPA 21956 of 2024.

These two writ petitions pertain to the same proceeding. Upon the joint prayer of the learned Advocates for the parties, the said writ petitions are taken up for hearing together.

While the first writ petition being WPA 22444 of 2022 challenges the show-cause notices issued upon the petitioner, the second writ petition being WPA 21956 of

2024 seeks direction upon the appellate authority to dispose of expeditiously the appeal that was filed challenging the final order of termination.

At this stage, learned counsel for the petitioner submits that a final order of termination has already been passed and the same has been challenged before the concerned appellate authority. As such, the petitioner would not like to press the first writ petition being WPA 22444 of 2022. However, if there is delay in disposing of the petitioner's appeal, that will cause irreparable harm and prejudice to the petitioner.

Learned Advocates for the College and the University submit that it would be in the interest of justice that the appeal filed is disposed of at the earliest.

It appears that an appeal has been preferred by the petitioner challenging the final order of termination of her employment.

Let the respondent No.2 in WPA 21956 of 2024 hear out and dispose of the petitioner's appeal in question without granting any unnecessary adjournment, in accordance with law and expeditiously, preferably within 12 weeks from the date of communication of this order. With these observations, both the writ petitions are disposed of.

Parties shall act on server copy of this order duly downloaded from the official website of this Court. [ Jay Sengupta, J. ]
