Mr. Siddhartha Banerjee Mr. Mridul Kanti Sasmal Mr. Safikul Mandal Mr. Tonmay Chatterjee Ms. Sunita Dhar ....for the petitioners This application under Article of the Constitution of India is at the instance of the defendant and is directed against an order being No.1 dated August 12, 2025 passed by the learned Additional District Judge, 1st Court at Sealdah in Miscellaneous Appeal No.49 of 2025.

After some argument, Mr. Banerjee, learned advocate for the petitioner on instruction submits that he is restricting his prayer in the civil revision application only to the extent of praying for a direction upon the learned Additional District Judge, 1st Court at Sealdah to dispose of the Miscellaneous Appeal No.49 of 2025 expeditiously.

Mr. Banerjee assures this Court that the petitioner shall enter appearance in the miscellaneous appeal on or before September 15, 2025.

CO 3350 of 2025 stands disposed of by requesting the learned Additional District Judge, 1st Court at

Sealdah to make an endeavour to dispose of the Miscellaneous Appeal No.49 of 2025 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

Since Mr. Banerjee only prayed for a direction for expeditious hearing of the miscellaneous appeal, it is made clear that this Court has not gone into the merits of the matter and the learned Judge of the Appellate Court shall be free to decide the same in accordance with law. There will be no order as to costs.
