In pursuance of the direction passed by this Court earlier dated 10.4.2025, a report is submitted by the Superintendent of Police, Cooch Behar, indicating that during pendency of the appeal the sole appellant/convict Jamir Ali Mia had passed away on 24.6.2021. The photocopy of certificate of death of the said appellant/convict Jamir Ali Mia, which was tagged with the report also affirms the death of the said appellant/convict. 4.

As the sole appellant/convict has been expired during the pendency of the appeal the instant appeal stands abated against him. 5.

Consequently, the application being CRAN 2 of 2009 (Old No. CRAN 1988 of 2009) stands disposed of.

Let the report submitted by the Superintendent of Police, Cooch behar be kept with the record.

Accordingly, the instant appeal being CRA 541 of 2007 is hereby dismissed as abated.

Let a copy of this order alongwith Trial Court Records be sent down to the Trial Court immediately.
