Abanti Dawn Mr. Ujjwal Trivedi Mr. Sujal Dey ...for the Petitioner This is an application wherein the petitioner has sought for expeditious disposal of the Title Suit being no. 88 of 2016 pending before the learned Civil Judge, 2nd Court, Purba Burdwan.
It is submitted that the petitioner filed aforesaid suit along with an application for temporary injunction. The application for temporary injunction was heard on 11th October, 2018 and thereafter it is still pending for adducing evidence on behalf of the plaintiff. He further submits that the petitioner is aged about 76 years and accordingly, he has prayed for a direction upon the court below for expeditious disposal of the aforesaid suit.
Since the prayer made by the petitioner is innocuous, service of application upon the opposite party is dispensed with.
Considering the fact that the prayed made by the petitioner is justified and that, if any order is passed in terms of the prayer made in the application, neither
party will have a cause to prejudice, the prayer is allowed.
C.O. 3562 of 2018 is accordingly disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the suit and to make his best effort to conclude the entire proceeding of the suit without granting any unnecessary adjournment to either of the parties, preferably within a period of six months from the date of communication of the order. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
