1. In view of the innocuous nature of the prayer, no prior service of notice on the opposite party is being directed.

2. The petitioner is the plaintiff in a suit for eviction instituted in the year 2018. Since then it is still pending at the stage of disposal of the application filed by the defendant/opposite party under Section 7(2) of the West Bengal Premises Tenancy Act, 1997.

3. In view of the inordinate delay in deciding the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997, this Court is of the opinion that appropriate directions for expeditious disposal ought to be passed.

4. Accordingly, C. O. No. 3130 of 2024 is disposed of by requesting the learned Civil Judge (Junior Division), Fourth Court at Alipore, District- South 24 Parganas to dispose of the pending application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 filed in connection with Title Suit No. 56 of 2018, pending before the said court, as expeditiously as possible, positively within four weeks from the date of communication of this order to the learned trial Judge.

5. It is made clear that the learned trial Judge is expected to take up the suit itself for disposal thereafter and to make all endeavour to dispose of the suit, being Title Suit No. 56 of 2018, as expeditiously as possible.

6. There will be no order as to costs.

7. The parties and all concerned shall act on the server copy of this order for the purpose of compliance without insisting upon prior production of the certified copy thereof.
