Versus

State of West Bengal and others Mr. Asish Dutta .... for the petitioners.

1. The writ petitioners complain that the private respondents have blocked a public pathway.

On an earlier occasion, the petitioner approached this Court by way of WPA 15335 of 2022.

2. By order dated 25.08.2022 the Court had directed the Police to maintain vigil in the said premises to ensure that no untoward incident takes place.

The Police shall continue to do so.

3. The blockage of Panchayat road is a matter of concern of the local Panchayat. The issue as to whether the road-in-question is a public road or not is required to be dealt with by the Panchayat.

4. The Local authority is empowered under the statute to remove any obstruction in public road.

5. The petitioner may approach before the Panchayat in this regard.

6. Chandrakona Police Station shall ensure that there is no breach of peace in the area.

7. The writ petition is disposed of.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
