This application under Article 227 of the Constitution of India has been filed for expeditious disposal of the Matrimonial Suit No.1268 of 2021 pending before the learned Additional District, 3rd Court, Howrah.

The present petitioner, being the husband, filed a suit under Section 13 of the Hindu Marriage Act in the year 2021.

The grievance ventilated that this matter is pending since long and has come up before this court with the prayer for expeditious disposal. On careful perusal of the record, it appears that a Misc. Case under Section 24 of the Hindu Marriage Act is also pending and it is a settled law that unless the said Misc. Case is disposed of, the matrimonial suit cannot be disposed of.

Be that as it may, the learned trial court is hereby directed to take all possible steps to dispose of the Misc. Case as well as the matrimonial suit pending before the learned court at an earliest.

In view of the same, the revisional application is disposed of.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
