The plaintiff in a suit for declaration for title, permanent injunction and recovery of khas possession has filed the instant application under Article 227 of the Constitution of India praying for expeditious disposal of Title Suit No.441 of 2017 pending before the learned Judge, 8th Bench, City Civil Court at Calcutta.
In view of the order sought and proposed to be passed, there is no necessity of issuing any notice upon the opposite parties herein.
It has been submitted by the learned Advocate for the petitioner that February 21, 2021 has been fixed for hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure filed by the plaintiff for amendment of the plaint as well as an application for stay filed by the defendant.
The learned court below is requested to take up the hearing of the aforesaid applications and to make all endeavours to dispose of the same as expeditiously as possible.
The petitioner shall be obliged to serve a copy of this order upon the opposite parties and/or the learned Advocate appearing for the opposite parties in the court below forthwith.
Co. 3587 of 2018 is thus disposed of.
There will, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
