Learned advocate appearing for the petitioner submits that the sole accused has been implicated on alleged recovery of 75 bottles of Phensedyl from his possession. The petitioner has been detained in custody for 9 months and during this period investigation has been concluded, chargesheet has been submitted and charge has been framed before the learned Trial Court.

Learned advocate for the State opposes the prayer for bail and submits that the petitioner has antecedents and previously 165 bottles of Phensedyl was recovered from the possession of the petitioner and subsequent recovery of the

present case prima facie is established which reflects that there is no remorse on the part of the petitioner. I have taken into account the period of detention of the present petitioner and the stage of the case, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the petitioner viz. Jamshed Mandal shall be released on bail upon furnishing bond of Rs. 20,000/- with two sureties of Rs. 10,000/- each, one of whom must be local, to the satisfaction of the learned Special Judge (under NDPS Act) cum Additional District and Sessions Judge, 3rd Court, Balurghat, Dakhin Dinajpur.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the District of Dakshin Dinajpur without the prior permission of the learned Special Court.

The application for bail, being C.R.M. (NDPS) 1139 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
