In view of the above, this Court is inclined to hold that allowing the proceeding to continue shall be a futile exercise. Proceedings of G.R. No. 906 of 2023 pending before the learned Additional Chief Metropolitan Magistrate, Kolkata presently redesignated as Additional Chief Judicial Magistrate, Kolkata be quashed.

The revisional application and the connected application being CRAN 1 of 2024 are disposed of.

The petitioners be set at liberty at once and discharged from their bail bonds.
