The instant intra court appeal is directed against the order dated 20th July, 2023 passed by a learned Single Judge of this Court in W.P.A. 16521 of 2023. 2.

The learned Single Judge found that the writ petitioner had not applied for transfer of FPS licence that existed in the father's name ,in her favour, on compassionate ground. In fact none of the legal heirs of the deceased licence holder had so applied. 3.

In such circumstances, the District Controller issued a fresh vacancy Notification on 19th April, 2022 against which the writ petitioner applied along with one Sadhan Pramanick and others. The District Level Team inspected the petitioner's godown and, found that the same was standing in the name of her mother. Sadhan Pramanick accordingly obtained 61 out of 75 marks whereas the writ petitioner/appellant obtained 42 marks.

In view of the above, the denial of FPS licence to the writ petitioner and grant of the same in favour of

Sadhan Pramanick calls for absolutely no interference by this Court.

M.A.T. 1706 of 2023 must fail and is hereby dismissed.

In view of dismissal of the appeal itself, the connected application being CAN 1 of 2023 shall also stand dismissed.

There will be no order as to costs.
