1. Heard learned Counsel for the petitioner. Learned Counsel for the Union of India is absent on call though noticed.

2. It is found from record that notice has been issued from the Cyber Police Station, Dwarka, New Delhi under Section 41A Cr.P.C. to the petitioner in connection with Dwarka Cyber Police Station Case No. 122 of 2022. Only because the account of the petitioner is in the bank of Kolkata, we cannot assume jurisdiction so far as the subject matter is concerned.

3. The petitioner also should not apprehend that only because notice under Section 41A Cr.P.C. has been issued, he shall be arrested on his appearance.

However, taking into consideration the apprehension of the petitioner, we dispose of the petition directing the petitioner to appear before the Cyber Police Station, Dwarka within a period of four weeks from today and the petitioner should not be arrested for a period of four weeks from today.

4. Accordingly, the application being CRM (A) 3922 of 2023 is disposed of.
