This is an application for expeditious hearing at the instance of the defendant in a suit for specific performance of contract.

The learned advocate appearing for the petitioner submits that the suit is pending since the year 2014 and the plaintiff is delaying the disposal of the title suit.

In my view, justice would be sub-served if direction for expeditious hearing of the suit is passed.

Accordingly, C.O. 3084 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), Purba Burdwan to dispose of the Title Suit No. 215 of 2014 pending before the learned Civil Judge (Senior Division), Purba Burdwan as expeditiously as possible without granting any unnecessary adjournments to either of the parties. 5.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
