1. The petitioner is aggrieved by the act on the part of the Archeological Survey of India in not issuing the completion certificate despite successful completion of the work in terms of the work order issued and even after the bills have been paid and security deposit released.

2. The petitioner applied before the authority for issuance of a completion certificate but the same has not been issued till date.

3. None represents the respondent authority despite service.

4. Affidavit of service filed in Court today is taken on record.

5. In the absence of the authority, the Court is not in a position to ascertain as to why completion certificate was not issued in favour of the petitioner.

6. The petitioner asserts that all payments and performance security deposit has been released. In such circumstances, the completion certificate ought not to have been withheld.

7. Be that as it may, as a prayer from the petitioner for issuing the completion certificate is pending consideration before the authority, accordingly, the instant writ petition is disposed of by directing the Superintending Archeologist, Archeological Survey of India being the respondent no. 2 herein to consider the prayer of the petitioner for issuance of the completion certificate in terms of the contract issued, at the earliest but positively within a period of three weeks from the date of communication of this order.

8. Learned advocate for the petitioner is directed to forward a copy of the representation along with all supporting documents in support of its claim to the aforesaid respondent at the time of communicating the order of the Court.

9. The writ petition stands disposed of.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
