For the State Report submitted by the State is taken on record. The petitioner is unhappy with the progress in investigation. He is a private limited company engaged in the business of construction and similar activities. The petitioner entered into an agreement with the private respondents for undertaking public work projects and invested Rs.1 crore with the said respondents. But neither any project was allotted to him nor the deposit refunded. The petitioner contacted the private respondents who assured return of the amount but despite passage of considerable period of time the amount was not returned.
The petitioner lodged complaint before the police authority on 16th January, 2025 and formal FIR was drawn up on the same date. It appears from the report submitted by the State that though FIR was registered before almost a year, there has not been much progress in investigation. Most of the private respondents are residents of other states. Several notices were issued upon them under Section 35(3) of the BNSS which were not responded to. Reminders were sent. Besides this, no step has been taken by the investigating officer either to interrogate the accused/private respondents or unravel the truth. Investigation has progressed in a very slipshod and lackadaisical manner.
are residents of other states and it is not unlikely that the case involves an inter-state criminal racket, this Court thinks it fit to transfer the investigation of the case to the Criminal Investigation Department, Government of West Bengal. The Director General of Police, Criminal Investigation Department is directed to depute a competent senior officer to conduct investigation in order to yield fruitful results. The investigation should be conducted in a fair, unbiased and impartial manner and taken to its logical conclusion in accordance with law. The investigating officer shall make over the case diary along with all relevant material to the concerned investigating officer of the CID at the earliest. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
