Criminal Revisional Jurisdiction Appellate Side 02.04.2024 Item No.21 BR CRR 2918 of 2017 In the matter of : Muni Ram Sharma @ Munilal Sharma (Vashisth) Nobody appears on behalf of either of the parties on call.

Petitioner being the accused filed this application under Section 401 read with Section 482 of the Code of Criminal Procedure,1973 seeking quashing of proceeding being CR Case No. 984 of 2016 presently pending before the learned Additional Chief Judicial Magistrate at Siliguri alleging thereby the commission of offence under Section 498A/34 of the Indian Penal Code read with Section 3 and 4 of the Dowry Prohibition Act including order dated 31st December, thereby issued process/summons against the accused persons and thereafter vide order dated 10.02.2017 warrant of arrest was issued against the accused person nos. 6 and 8.

This case is pertains to year 2017. Despite of giving opportunity by

this Court no one represented the petitioner. No accommodation sought for.

Under the above facts and circumstances it seems that the petitioner is no more interested to proceed with the case.

Accordingly, CRR 2918 of 2017 is,thus, dismissed for default. Interim order, if any, is hereby vacated.

Let a copy of this order be communicated to the learned Court below for information and for taking necessary action.

Urgent xerox certified copy of this order, if applied for, be given to the learned advocate for the parties on usual undertakings.
