Mr. Somnath Banerjee ... for the petitioner The Officer-in-Charge, Nanoor Police Station, Birbhum has filed a compliance report dated 18.09.2023 stating that the opposite party No.1 has expired supported by a copy of the death certificate. Let the said report be kept on record. The petitioner had appeared before the learned Registrar Administration ( L & OM) on 23.11.2023 as stated by the learned advocate for the petitioner.
The instant revisional application was filed by the petitioner being son of the opposite party No.1 being aggrieved by the judgment and order dated 16th August, 2011 passed by the learned Additional District and Sessions Judge, 4th Court, Suri, Birbhum in Criminal Revision No. 23 of 2011 affirming the order dated 22nd February, 2011 passed by the learned Additional Chief Judicial Magistrate, Bolpur, Birbhum in Miscellaneious Case No. 128 of 2010. Both the learned trial courts were of the opinion that the petitioner being the son of the opposite party No.1 was liable to maintain him. However, since the opposite party No.1 has already expired, the instant
revisional application has become infructuous and accordingly disposed of.
Copy of the order be sent to the Department and learned trial court for information.
