Affidavit of service filed on behalf of the petitioner is taken on record.

It is submitted that petitioner was appointed as Assistant Teacher in Mathematics on 12th August, 2010 and was sanctioned Honours graduate scale of pay. It is also submitted that petitioner obtained post-graduate qualification from Burdwan University in 2011 but till date postgraduate scale of pay has not been accorded in favour of the petitioner. It is contended that since petitioner obtained higher qualification in relevant subject of teaching she is entitled to receive postgraduate scale of pay. A representation was made on 25th June, 2025 to the District Inspector of Schools (SE), Hooghly being respondent no. 3 seeking sanction of post-graduate scale of pay. 3.

State respondents are represented by Mr.

Vaisya, learned Additional Government Pleader who

submits that since the issue is pending same needs to be considered in accordance with law.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing respondent no. 3 to take decision on representation of the petitioner dated 25th June, 2025 by six weeks from date of communication of this order after granting opportunity of hearing to the petitioner and the school authority or their representatives. A reasoned order shall be passed by respondent no. 3 and same shall be communicated to the petitioner by fortnight thereafter.

It is made clear while taking decision respondent no. 3 shall follow the judgment of the Special Bench dated 7th February, 2024 delivered in WPA 9921 of 2007 (Utpal Kanti Karan Vs.

State of West Bengal & Ors.) .

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
