An application made by the petitioner seeking permission for holding a procession on 3rd September, 2024 on and from Rabindra Sadan to Hazra More between 3 p.m. to 8 p.m. is pending consideration at the end of the Joint Commissioner of Police.

Learned advocate representing the State respondents fairly submits before this Court that the State does not have any objection if the time for holding the procession is regulated and the office hour is avoided.

It has been submitted that the stretch where the procession is scheduled to be held is a congested one,

especially the end point. The traffic congestion increases during office hours.

In view of the submission recorded hereinabove, the instant writ petition is disposed of by directing the Joint Commissioner of Police to issue a formal permission in favour of the petitioner for holding the procession on 3rd September, 2024 positively by 1st September, 2024. The time period during which the procession may be held shall be mentioned in the permission to be issued by the aforesaid respondent. At the time of fixing up the time period for holding the rally, the aforesaid respondent shall take note of the direction passed by this Hon'ble Court on 20th August, 2024 in WPA 21122 of 2024 (Dr. Swapan Dasgupta & Anr. Vs. The State of West Bengal & Ors.). It is expected that the procession will be a peaceful one and would not disturb the public in general. The organizers shall ensure that the pollution norms are strictly complied with and are not violated in any manner.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
