1. Although the appellant can be innocent, however, having regard to fact that an embargo was introduced on 31st May, 2010 and the purported panel prepared was never ever formally approved by the Managing Committee of the said school and no approved panel have ever been received by the District Project Officer, Sarba Shiksha Mission, Paschim Medinipur, no relief can be granted to the writ petitioner.

2. Accordingly, the appeal and the application stand dismissed.

3. However, there shall be no order as to costs.

4. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
