Petitioners are directed to serve a copy of the revisional application upon Mr. Sanjib Kumar Dan, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioners is aggrieved by the manner in which the proceedings are progressing before the learned Judicial Magistrate, 1st court, Uluberia.

Learned advocate submits that the charge in this case was framed in the year 2018, but till date none of the witnesses turned up in support of the prosecution case and the next date has been fixed on 15th March, 2024.

The genesis of the case is Uluberia P. S Case No. 106 of 2017 which was registered on 4th February, 2017. Having considered the fact more than six years have passed since the agony is faced by the present petitioners in the pendency of the criminal trial, I direct that the learned trial court, on and

from 15th March, 2024 the next date so fixed, to fix at least one date in a month for the purposes of the case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

In case, if any of the witness is absent on the date so fixed or any witnesses is reluctant to appear, then in that case the SDPO/DSP of the concerned jurisdiction would be communicated who would ensure the presence of the witnesses on the dates so fixed.

All efforts be taken so that by 31st January, 2025 at least the evidence of the prosecution is completed. Thereafter, the examination under Section 313 Cr.P.C be completed by 15th March, 2025. Defence be granted 2/3 months' time and the learned Judicial Magistrate, 1st court, Uluberia will pronounce his judgement by 30th June, 2025.

With the aforesaid observations, the present revisional application being CRR 3361 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
