Mr. Shashwat Nayak Ms. Akansha Mukherjee Mr. Sunit Biswas Ms. Rajashree Bhowmick ....for the petitioners On the prayer of the learned advocate for the petitioner, leave is granted to the learned advocate on record of the petitioner to amend the cause title of the civil revision application here and now.

This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Additional District Judge, 7th Court at Alipore to dispose of the Miscellaneous Appeal No.35 of 2024 expeditiously. The learned advocate appearing for the petitioner submits that miscellaneous appeal arises out of an order refusing to pass an ad interim order of injunction by the learned trial judge. He submits that the miscellaneous appeal is otherwise ready for hearing.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be

obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned trial judge.

In the light of the submission made by the learned advocate for the petitioner, CO 3360 of 2025 stands disposed of with the hope and trust that the learned Additional District Judge, 7th Court at Alipore shall make an endeavour to dispose of the Miscellaneous Appeal No.35 of 2024 as expeditiously as possible but preferably within a period of four months from the next date. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
