Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Rudradipta Nandy, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 14.01.2021. Having regard to the period for which the petitioner is detained, I am of the view that the anxiety expressed by the petitioner is justified.

It has been submitted that till date out of 36 witnesses, only one witness has been examined by the learned Special Court. Next date, as has been informed, is fixed on 12.12.2023. Having regard to the period for which the present petitioner is detained in custody, I direct that the learned trial court will fix a schedule of three dates and fix such schedule on each and every 20 days on and from the month of December 2023. There are 36 witnesses. Thus, efforts be taken so that at least examination or evidence of 30 witnesses

are completed by December 2023.

No unnecessary adjournment should be granted to either of the parties. If any of the witness is reluctant to appear or is not present on the date so fixed, the learned Special Court would communicate with the Superintendent of Police of the concerned district who would take steps for ensuring the presence of the witness on the date so fixed by the learned trial court.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 3363 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
