Earlier by an order dated 18.02.2022 a report was called for from the Officer in Charge, Bhaktinagar Police Station, through Learned advocate appearing for the State for recording of the statement to ascertain regarding the willingness of the opposite party no.2 in pursuing Bhaktinagar Police Station Case No.347/2017.

Today when the matter has been called Mr. Saswata Gopal Mukherjee, Learned Additional Public Prosecutor, High Court, Calcutta appearing in this matter submits a report in which the statement of the complainant as well as the letter addressed by the complainant to the Officer in Charge, Bhaktinagar Police Station has been enclosed. Let the report be kept with the record. Having regard to the report that already the marriage has been dissolved by way of decree of divorce under Section 13B of the Act, and the report so submitted by the Officer in Charge, Bhaktinagar Police Station which is on the basis of the statement

so recorded, I am of the opinion that further continuance of the Bhaktinagar Police Station Case No.347/2017 dated 05.04.2017 under Section 498A/354 of the Indian Penal Code is unwarranted. Accordingly, all further proceeding of Bhaktinagar Police Station Case No.347/2017 is hereby quashed.

Thus, CRR 3046 of 2018 is allowed.

Interim order, if any, is make absolute.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
