This is an application under Section 482 of the Code of Criminal Procedure filed by the accused of the petitioner praying for quashing of the proceeding in G.R. Case No.4685 of 2015 arising out of Lake Police Station Case No.386 of 2015 dated 14th October, 2015 under Sections 409/468/471/420/120B of the Indian Penal Code.
None appears for the petitioner when the matter is called on for hearing.
It is ascertained from the record that the instant revision is filed by the petitioner alleging inter alia that he was not named in the FIR, but, in the charge sheet, his name appeared as he is one of the Directors of the company against whom allegation was made in the FIR.
I have already recorded that charge sheet was filed in the year 2015 upon which G.R. Case No.4685 of 2015 is registered.
By filing the instant application, the hearing of the criminal case has been stalled for about six years. This should not be the purpose of criminal administration of justice. A procedural provision cannot be used as a tool to stall the hearing of a criminal case. In view of such circumstances and also for the reason that the petitioner is absent when the matter is called on for hearing, the instant criminal revision is dismissed.
