Petitioner has approached this Court as the representation made on or about 18.08.2025 to the Officer-in-Charge, Bagnan Police Station did not yield any result. Petitioner is aggrieved as she is unable to enjoy the property.

Records reflect that earlier WPA 9260 of 2025 was preferred by the same petitioner and on 06.05.2025 this Court pass specific directions. State has submitted a report. Report reflects earlier Bagnan PS Case No. 254 of 2025 was registered for investigation and charge sheet has been submitted. Presently on receipt of such information police authorities have drawn up proceedings under section 126 of the BNSS.

Learned advocate for the private respondents denies and disputes the contention and further submitted that TS No. 166 of 2025 is pending before the jurisidictional Court.

Having considered that a long standing family feud is existing in respect of an undivided property, I am of the view that the earlier direction so passed by this Court on 06.05.2025 be reiterated. Police authorities have already drawn up proceedings under section 126 of the BNSS. They will continue their surveillance and ensure that no violation of law and order and/or any breach of the peace takes place.

With the aforesaid observations WPA 21649 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
