Petitioner is directed to serve a copy of the revisional application upon Mr. Anwar Hossain, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. The petitioner is aggrieved by the manner in which the Noapara P. S. Case 183 2015 dated 21.07.2015 is progressing before the learned Judicial Magistrate, 2nd court, Barrackpore. According to the learned advocate date has been fixed for evidence since 18th May, 2022. Further, till date no witness has been examined in connection with the instant case. The case is under Section 498A/406 of the Indian Penal Code. The present petitioner happens to be the husband of the complainant. Having regard to the fact almost 8 years have passed since the initiation of the case, I direct the learned trial court to fix at least two dates in every three months so that the trial of the case can be concluded within a reasonable period of time.
In case the witnesses do not appear or the process is not properly executed, the learned trial court will be at liberty to take assistance by passing necessary directions upon the Officer-inCharge of Women Grievance Cell of the Barrackpore Police Commissinerate. All efforts be taken by the stake-holders to complete the trial at the earliest.
With the aforesaid observations, the present revisional application being CRR 3595 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
