Saidullah Mr. Mithun Mondal Mr. Mohammad Arsalan ... for the petitioners Mr. Arindam Sen Mr. Parvej Anam ... for the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. An altercation took place regarding the issue of returning money. The petitioner No.2 is the cousin brother of the petitioner No.1.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the case diary and points to the statements of the victim and other witnesses and the injury report. He submits that the petitioners and other miscreants armed with iron road and other weapons entered into a club and assaulted the victim. Assault was made on the back side of chest and the face. Six stitches had to be given for repairing the injury.

Considering the brazen manner in which the petitioners allegedly came inside the premises and assaulted the victim on vital parts of the body causing serious injury and taking into consideration the criminal antecedents of the petitioners, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
