And In the matter of: Subhas Halder ....Applicant/Petitioner Mr. Asraf Mandal ...for the petitioner Mr. Imran Ali M. Arup Sarkar ..for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. There is a delay of about seven months in lodging the FIR. The petitioner has been falsely implicated in this case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail.

According to the statement of the victim recorded before the learned Magistrate, due to certain reasons, the victim was not in a position to file a complaint at an earlier stage. But, the objectionable video made by the accused and threats were given to murder the husband and the children of the victim prompted the petitioner to finally lodge the FIR. Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
