1. In view of the innocuous nature of the prayer, no prior service of notice on the opposite party is being directed.

2. The present matter arises out of Miscellaneous Case No. 190 of 2018 (ActVIII), which is for custody of the minor child of the parties.

3. Learned counsel for the petitioner submits that an application under Section 12 of the Guardians and Wards Act, 1890, has been disposed of by granting visitation rights.

However, the main matter has been kept pending since the year 2018.

4. Keeping in view the nature of the proceeding and the implicit urgency involved in custody matters, this Court is of the opinion that the matter ought to be decided expeditiously.

5. Accordingly, C. O. No. 3145 of 2024 is disposed of by requesting the learned Additional District Judge, Third Court at Barasat, District- North 24 Parganas, to dispose of Miscellaneous Case No. 190 of 2018 (Act-VIII), pending before the said court, as expeditiously as possible, positively within December 31, 2025.

6. There will be no order as to costs.

7. The parties and all concerned shall act on the server copy of this order for the purpose of compliance without insisting upon prior production of the certified copy thereof.
