This is an application under Section 482 of the Code of Criminal Procedure, 1973 for quashing of the proceedings being Special Case No.18 of 2009 pending before the learned Additional Sessions Judge, 3rd Court, Barasat, North 24 Parganas under Sections 408/409/120B of the Indian Penal Code. It is submitted by the learned Advocate for the petitioners that in the meantime he filed an application under Section 167(5) of Cr. P.C. However, that petition has been rejected and Prosecution was directed to submit the charge-sheet. He has been instructed by the petitioners namely, Mr. Murari Lal Sharma and another that in view of such development, the learned Advocate-on-Record is directed to withdraw the criminal revisional

application from this Court without entering into the merits of the matter.

Learned Advocate for the State is present.

A fresh Vokalatnama has been filed by Mr.

Aniruddha Ganguly, learned Advocate after obtaining 'no objection' from the erstwhile Advocate. It is reflected in the CIS system.

Heard the submission of the learned Advocate for the petitioners.

Let Criminal Revisional Application being CRR 3545 of 2009 be dismissed as withdrawn.
