Learned advocate appearing for the petitioner submits that in spite of direction passed in TS No. 169 of 2025 dated 11.07.2025 wherein the learned Civil Judge (Junior Division), 3rd Court, Serampore, Hooghly directing the Officer-in-Charge of Chanditala Police Station, Serampore to take necessary steps for implementing the order ensuring that the defendants are not able to raise any construction over the suit property. The same is being violated by the private respondents and the police authorities are not paying any heed to the order passed by the learned Civil Judge.

State has submitted a report. Report reflects that on receipt of the information, Chanditala PS Case No. 700 dated 14.09.2025 has been registered for investigation under the relevant

provisions of BNS, 2023 and the investigation of the said case is in progress. All possible steps have been taken by the police authorities.

In view of the police authorities already having registered a case, so far as the other violations are concerned, if there is a breach of the civil court's order, petitioner would be at liberty to approach the same Civil Court, for necessary reliefs. Petitioner, if so advised, would produce materials before the concerned Civil Judge to portray that the police authorities had any role to aid and assist the private respondents. In the meantime, I direct the police authorities since they have already registered a case to ensure that there is no breach of the peace and tranquility and/or any violation of law and order. To that aspect, proper surveillance be maintained by the police authorities.

With the aforesaid observations WPA 21645 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
